1. Acceptance of Terms

By accessing or using Photoshoot AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

2. Description of Service

Photoshoot AI is an AI-powered platform that generates professional photoshoots from user-uploaded images. Our service includes:

  • AI-powered image generation and transformation
  • Multiple photoshoot styles and customization options
  • Image refinement and enhancement features
  • Cloud storage for generated photoshoots
  • Subscription and token-based payment options

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that:

  • You are at least 13 years of age
  • You have the legal capacity to enter into these Terms
  • Your use of the Service will not violate any applicable law or regulation

4. Acceptable Use

You agree not to use the Service to:

  • Upload, generate, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Violate any laws, regulations, or third-party rights
  • Upload images containing nudity, explicit content, or content that violates others' privacy
  • Impersonate any person or entity or falsely state your affiliation
  • Upload malicious code, viruses, or harmful software
  • Attempt to gain unauthorized access to the Service or related systems
  • Use automated systems to access the Service without permission
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Resell or redistribute the Service or generated content for commercial purposes without authorization
  • Interfere with or disrupt the Service or servers connected to the Service

5. User Content

5.1 Ownership

You retain ownership of images you upload to the Service. By uploading content, you grant us a limited, non-exclusive, worldwide, royalty-free license to:

  • Use, store, and process your images to provide the Service
  • Generate photoshoots based on your images
  • Display your generated photoshoots within the Service

5.2 Generated Content

You own the photoshoots generated from your images. However, you may not:

  • Use generated content in ways that violate these Terms or applicable laws
  • Claim that AI-generated content represents real individuals without disclosure
  • Use generated content for fraudulent or deceptive purposes

5.3 Content Removal

We reserve the right to remove any content that violates these Terms or is otherwise objectionable, at our sole discretion, without prior notice.

6. Payments and Subscriptions

6.1 Payment Terms

The Service offers both subscription plans and token-based purchases:

  • Subscriptions: Recurring monthly payments for premium features
  • Tokens: One-time purchases for individual photoshoot generations
  • All payments are processed securely through Stripe
  • Prices are subject to change with 30 days' notice

6.2 Subscription Terms

  • Subscriptions automatically renew unless cancelled
  • You may cancel your subscription at any time
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial subscription periods unless required by law

6.3 Refunds

Refund requests are handled on a case-by-case basis. Generally, we do not provide refunds for:

  • Used tokens or consumed subscription benefits
  • Dissatisfaction with AI-generated results
  • User error or misunderstanding of features

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Photoshoot AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee:

  • Uninterrupted or error-free operation
  • Immediate resolution of all technical issues
  • Availability during maintenance periods

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Accuracy, reliability, or completeness of generated content
  • Uninterrupted or error-free operation

AI-generated content may not always meet your expectations. We are not responsible for the quality, accuracy, or suitability of generated photoshoots for your intended use.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PHOTOSHOOT AI BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your use or inability to use the Service
  • Damages resulting from unauthorized access to or alteration of your data

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Photoshoot AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service, violation of these Terms, or infringement of any rights of another party.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment of fees
  • Extended periods of inactivity

Upon termination, your right to use the Service will cease immediately. We may delete your account and associated data, though some information may be retained as required by law.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in [Your Jurisdiction].
